B-Sure DNA Terms & Conditions
Acceptance of Terms: By placing an order with B-Sure DNA, the purchaser acknowledges that the purchaser has reviewed and agrees to these Terms & Conditions, the B-Sure DNA Privacy Policy, the B-Sure DNA Return & Refund Policy, and any additional requirements disclosed for the DNA testing service purchased.
Eligibility and Authority to Order Testing: The purchaser must be at least 18 years old and must have the authority and any consent required to order the requested DNA testing. When testing involves another individual, the purchaser represents that the purchaser has appropriate authorization to provide that participant's information and arrange for the participant's testing. When testing involves a minor, the purchaser represents that the purchaser has the legal authority or authorization required to arrange testing for that minor. B-Sure DNA may request additional consent, identification, documentation, or authorization before processing an order or DNA testing case.
Accuracy of Information: The purchaser is responsible for providing complete and accurate customer, participant, shipping, and testing information. B-Sure DNA should be notified promptly if information associated with an order is incorrect or changes. Incorrect or incomplete information may delay case setup, sample collection, shipment, laboratory testing, or delivery of results.
Authorization for DNA Testing: By ordering DNA testing and submitting or authorizing the submission of DNA samples, the appropriate participant or authorized representative authorizes the submitted samples and associated participant information to be provided to the laboratory partner for the DNA testing requested. Additional laboratory consent or authorization requirements may apply before testing is performed.
At-Home DNA Testing: At-Home DNA Tests are intended for personal knowledge and are not represented by B-Sure DNA as legal or court-admissible tests. Customers are responsible for following the collection instructions supplied with the testing materials and for properly labeling, handling, and returning samples as instructed. At-Home testing does not use the professional chain-of-custody collection procedures required for Legal DNA Testing.
Legal DNA Testing: Legal DNA Tests require professional DNA sample collection and documented chain-of-custody procedures. Testing participants must comply with applicable identification, documentation, photograph, signature, and collection requirements. Customers must not self-collect samples for a Legal DNA Test. B-Sure DNA will coordinate professional collection according to the service purchased.
Laboratory Services: B-Sure DNA coordinates and facilitates DNA testing services. Laboratory analysis is performed by B-Sure DNA's laboratory partner. Laboratory testing, analysis, sample handling, quality procedures, and issuance of laboratory results are performed according to the laboratory's applicable procedures, requirements, and legal obligations.
DNA Samples and Collection: Customers and testing participants are responsible for following applicable sample-collection instructions and requirements. Improperly collected, contaminated, mislabeled, insufficient, altered, or otherwise unsuitable samples may require recollection and may delay testing. Additional charges may apply when additional collection, replacement materials, or other services are required because of circumstances attributable to the customer or testing participants. Any additional charge will be disclosed before the additional service is provided.
Test Results: DNA relationship testing evaluates the biological relationship indicated by the samples and information submitted for the requested test. B-Sure DNA does not guarantee that any particular test result will establish, change, or determine legal parentage, custody, child support, inheritance rights, birth-certificate information, immigration status, or any other legal right or status. Courts, government agencies, and other applicable authorities determine how DNA test results may be accepted or used.
Customer Responsibilities: Customers and testing participants must not knowingly provide false information, misidentify a participant, substitute another person's sample, tamper with samples, interfere with chain-of-custody requirements, or use B-Sure DNA services for an unlawful or unauthorized purpose.
Right to Pause or Decline Processing: B-Sure DNA may pause, decline, or cancel processing when required information or authorization is missing; participant identity or authority to authorize testing cannot be established when required; collection requirements have not been satisfied; an order cannot be fulfilled as requested; or B-Sure DNA reasonably determines that processing the case may violate applicable law, laboratory requirements, or these Terms. Any applicable refund will be handled according to the B-Sure DNA Return Policy and applicable law.
Professional Collection Appointments: Customers purchasing Legal DNA Testing must comply with the scheduling, cancellation, rescheduling, late-arrival, and no-show requirements disclosed for the purchased service. Applicable fees and refund conditions are governed by the B-Sure DNA Return Policy and the service-specific information presented before purchase.
Privacy and Confidentiality: Personal information, testing-participant information, DNA samples, and DNA test results are handled in accordance with the B-Sure DNA Privacy Policy and the applicable procedures of the laboratory and service providers involved in fulfilling the requested service.
Returns, Refunds and Cancellations: Purchases, cancellations, rescheduling, returns, refunds, damaged or incorrect kits, and remedies required by applicable law are governed by the B-Sure DNA Return Policy applicable to the order.
Service and Turnaround Times: Any stated laboratory turnaround time begins only when the laboratory has received all samples and information required to perform the requested testing, unless otherwise stated. Shipping, collection scheduling, recollection, incomplete information, laboratory review, and circumstances outside B-Sure DNA's reasonable control may affect the overall time required to complete an order.
No Medical or Legal Advice: B-Sure DNA provides DNA testing and related coordination services. B-Sure DNA does not provide medical diagnosis or treatment, legal advice, or legal representation. Customers should consult an appropriately qualified professional when medical or legal advice is needed.
Changes to an Order: Changes requested after an order is placed may require review by B-Sure DNA and may result in additional fees, collection requirements, laboratory requirements, or processing time. Any additional fee will be disclosed before the additional service is provided.
Changes to These Terms: B-Sure DNA may update these Terms & Conditions as its services, business practices, laboratory requirements, or applicable requirements change. The current version will be made available through the B-Sure DNA website. Changes will not limit rights or remedies required by applicable law.
